Official Rules

Contest Period

  • The iCORN.com $30,000 Seeds of Knowledge video Contest (the Contest) begins at 12:00:01 p.m. Eastern Time on September 1, 2008, and ends at 11:59:59 a.m. Eastern Time on November 28, 2008 (Contest Period).

Eligibility

  • Participating students (Participants) must be age 14 or older as of September 1, 2008, and legal residents of Indiana, Ohio, Illinois, Michigan or Wisconsin.
  • By accepting the prize, each Contest Winner (Contest Winner) agrees to apply the full sum of the prize to expenses directly related to post-secondary education, including but not limited to general tuition, room and board, lab fees, books or similar instructional materials. Post-secondary education includes traditional four-year colleges and universities, community colleges, technical training services, online instruction, vocational or technical institutions or other comparable education providers.
  • iCORN Inc. (the Sponsor) retains the right to require a signed affidavit or other form of proof to verify each Contest Winner’s compliance with the requirement to apply all prize money to expenses related to post-secondary education before awarding prizes.
  • Each Participant must include with his/her entry the name of a nominating iCORN.com customer. Any living person who has purchased corn or soybean seed from iCORN.com qualifies as an iCORN.com customer. iCORN.com customers may nominate up to five Participants, including their own children and other relatives. However, iCORN.com customers are prohibited from nominating themselves or another iCORN.com customer. iCORN.com customers also cannot enter the Contest without a Participant who submits a video.
  • Employees, employee family members and agents of iCORN, Inc., Monsanto Company, 5MetaCom, BitWise Solutions Inc. and their respective parent companies, affiliates, subsidiaries or any other entity involved in the development or production of the Contest are not eligible.

To Enter

  • To enter the Contest, Participants must visit www.icorn.com/Contest (the Contest Website) and click on the Submit your video link. Participants must complete the entry form and upload a video as instructed. Each entry must include a video. Videos must be submitted on the Contest Website and will not be accepted via other delivery methods.
  • Videos may not be longer than 90 seconds. They may, however, be shorter than 90 seconds. Video file sizes must not exceed 1GB.
  • Most common video file formats (.WMV, .AVI, .MOV and .MPG) are acceptable. Video submissions that are incompatible with the Contest Website will not be accepted. Participants must comply with all instructions when submitting a video.
  • Participant is responsible for securing written permission from all persons/subjects included in the video; this criterion must be satisfied before prizes will be awarded. The Sponsor assumes no responsibility for royalties or fees associated with talent performances in the videos.
  • Participants are limited to one entry apiece. If multiple entries are received from one Participant, all of that Participant’s entries shall be disqualified.
  • By entering the Contest, Participants agree to compliance with and acceptance of all Contest Rules (Rules), criteria and guidelines associated with this Contest.

Voting

  • By entering the Contest, Participants agree that their videos may, at the sole discretion of the Sponsor, be posted online for public viewing and voting. Participants acknowledge that all videos that meet Contest criteria and are posted on the Contest Website are concurrently publicly available on YouTubeTM.
  • Public voting will take place during the Contest Period. The use of robotic or automated devices or programs for voting is prohibited, and the Sponsor reserves the right to nullify all such prohibited votes at its discretion. Sponsor also reserves the right to disqualify any Participant found engaging in such activities.
  • All votes must be completed and submitted by 11:59:59 a.m. Eastern Time on November 28, 2008.
  • The top three winners shall be determined by the total number of votes received at the Contest Website during the Contest Period, as tabulated by the Sponsor and/or its affiliates. Vote totals calculated and determination of winners by the Sponsor and/or its affiliates are final.
  • Winners will be determined not later than December 12, 2008.

Prizes

  • Prizes will be awarded to 3 separate Participants (Contest Winner) and the nominating iCORN.com customer (Nominating Winner) named on his/her entry.
  • The Participant whose video receives the highest total votes will receive $20,000; the Participant whose video receives the second highest total votes will receive $7,500; and the Participant whose video receives the third highest total votes will receive $2,500.
  • In the event the Contest Winner is a minor (age 14-17), the prize shall be placed, at the discretion of the Sponsor, into a CollegeChoice 529 Investment Plan, a trust or an account at a financial institution of the Sponsor’s choice. The CollegeChoice 529 Investment Plan, trust or account shall, to the extent the law allows, restrict the use of the prize to post-secondary education purposes and prohibit access to the prize until the Contest Winner has enrolled in a qualifying post-secondary educational program.
  • In the event a Contest Winner fails to enroll in a post-secondary educational program or institution by 11:59:59 p.m. Eastern Time on December 31, 2015, the prize shall be forfeited.
  • In the event of a tie, the Contest Winner or winners shall be determined by a tiebreaker as follows:
    • First tiebreaker: Contest Winners shall be determined according to date of video submission, with the earliest submission being declared the winner.
    • Second tiebreaker: Contest Winners shall be determined based on the highest grade-point average among the tied Participants for the most recently completed full grade of school (based on a 4.0 scale).
  • Failure to comply with any of the Rules can result in the forfeiture of any and all winnings at the discretion of the Sponsor.
  • Each Nominating Winner will receive an iCORN.com account credit redeemable for purchase of iCORN.com corn or soybean seed. The Nominating Winner will be able to choose from the Sponsor’s available seed products. The amount of the credit will correspond to the value of the prize won by the Contest Winner.
  • Each Nominating Winner will have 365 days from notification in which to redeem his/her prize. If the account credits remain unused after 365 days from notification, the prize will be forfeited.
  • Prizes are non-transferable. No substitution of prizes is permitted except at the discretion of the Sponsor, which reserves the right to substitute a comparable prize of similar or greater.
  • All federal, state and local taxes, and other costs or expenses, are the sole responsibility of the Contest Winners and Nominating Winners.

Notification of winners

  • Contest Winners will be notified by telephone or email by December 19, 2008. Contest Winners and Nominating Winners may be required to sign a Publicity/Liability Release and W9 Taxpayer Identification Form. Contest Winners also may be required to provide a copy of his/her birth certificate, driver’s license or other form of identification as proof of age and residency. If a prize is won by a minor, the minor’s parent or legal guardian must provide the required documentation on the minor’s behalf.
  • If a Contest Winner cannot be contacted within 14 calendar days of the first notification attempt, or if the prize notification is undeliverable, or if the Contest Winner is determined to have not complied with the Rules, the prize will be forfeited and an alternative Contest Winner will be selected from the remaining eligible entries. Prize forfeiture by a Contest Winner also results in forfeiture of prize by the corresponding Nominating Winner. No compensation will be provided upon forfeiture of the prize.
  • By accepting the prize, the Contest Winner and Nominating Winner releases and discharges the Sponsor and its affiliates, subsidiaries, advertising and promotion agencies, and all their respective employees, officers, directors, representatives and agents from any liability or damage due to the acceptance, possession or misuse of any prize in this Contest.
  • A list of winners will be posted at www.icorn.com no later than January 1, 2009.

Restrictions

  • All of the following content is strictly prohibited:
    • Nudity, obscenity, vulgarity, lewd or inappropriate images or text, as determined by the Sponsor.
    • Acts or implications of violence or bodily harm.
    • Any material that violates or may infringe on a copyright, trademark, logo, brand or other proprietary right of any other person (living or deceased) or entity.
    • Gang signs or symbols.
    • License plates, phone numbers, personal addresses or other personal information.
    • Invasion of publicity or privacy against any person.
    • Defamation of any person.
    • Derogatory characterizations of any ethnic, racial, sexual or religious groups.
  • The Sponsor reserves the right not to accept entries that are considered inappropriate for the Contest.
  • Participants are liable for any copyright or trademark infringements caused by their videos and agree to indemnify the Sponsor and any of its subsidiaries and affiliates from any and all claims, damages or losses for such claims.
  • Participants acknowledge that the contents of the video are wholly original, created entirely by the Participant, without help or assistance from professional videographers, photographers or others, and that the contents have not been taken from any other source.
  • The Sponsor assumes no responsibility for lost, damaged or late entries, or for incomplete computer transmissions or technical failures.
  • Entries that are incomplete, damaged, forged or irregular are void.
  • Any entry not in compliance with the above will be disqualified.

Waiver of rights

  • All videos become the property of the Sponsor and will not be returned.
  • Participants and Contest Winners agree that the Sponsor has the right to edit, reproduce and otherwise use the videos as it sees fit for promotional and other purposes.
  • Participants and Contest Winners grant the Sponsor a perpetual, royalty-free license to use the video, including the film, video, stills, concepts, etc., associated with the Contest entry as part of any promotional or advertising efforts.
  • Except where legally prohibited, submission of an entry into this Contest constitutes permission for the Sponsor to use the Participant’s and winner’s name, photograph, likeness, voice, address and testimonials, in print, broadcast media or new media, in perpetuity, in any manner the Sponsor deems appropriate in connection with promoting the video submission itself or this Contest, without further compensation in connection with this Contest or the prize awarded.
  • The Sponsor recognizes that creators of submitted material retain any copyrights in the video and in any materials subject to the license granted to the Sponsor.
  • Participants and Contest Winners agree that the Sponsor and those involved in the development, production, implementation and distribution of this Contest and their respective parent companies, affiliates, subsidiaries, service providers, and agencies, and their directors, officers, agents, employees, attorneys, and any other person or entity associated with such entities and/or promotion shall not be liable for any and all claims, damages, losses or injuries, including any third-party claims, arising from or relating to, in whole or in part, this Contest, including entry and participation in this Contest and acceptance, possession, use or misuse of the prizes. All Participants and Contest Winners further agree that in the event of any third-party claims, damages, losses or injuries, arising from or relating to this Contest, they will indemnify the Sponsor from any and all such claims, including the attorneys' fees related thereto.
  • The Sponsor shall not be responsible for any technical malfunctions of the telephone network, computer online system, computer equipment, software, program malfunctions or other failures, delayed computer transactions or network connections that are human, mechanical or technical in nature, or any combination thereof, including any injury or damage to Participant’s or any other person's computer related to or resulting from uploading/downloading as part of this Contest.
  • In the event the Contest Winner is a minor (age 14-17), a parent or legal guardian will be required to execute required documentation and rule fulfillment on the minor’s behalf.
  • Any person attempting to defraud or in any way tamper with this Contest will be ineligible for prizes and may be prosecuted to the full extent of the law.

Other considerations

  • The Sponsor reserves the right to modify, suspend or cancel the Contest at its sole discretion and to modify the Rules of the Contest in any way or at any time, as long as reasonable notice is given. The Sponsor further reserves the right to select winners from all eligible entries received prior to the cancellation date.
  • Any dispute or situation not covered by these Rules will be resolved by the Sponsor’s management in a manner deemed by them the fairest to all concerned. That decision shall be final and binding on all Participants.
  • This Contest is subject to all federal, state and local laws and regulations. Indiana courts shall have sole jurisdiction of any matters arising from this Contest, and the laws of the state of Indiana shall exclusively govern this Contest.
